RLLC is a very important test every business has to pass regularly. Studies point out that businesses in India are so heavily regulated that they have to comply with 1536 Union and State laws and 69,233 compliance procedures. Labour laws and compliances comprise 30% of the number of laws (463 Acts), 47% of the number of compliances – 32,542.
Non-compliance invites penal procedures and imprisonment. A whopping 68% i.e. 17,189 of criminal clauses are from labour laws. The Hon’ble Minister of Labour & Employment, GOI realising the regulatory cholesterol had in a press note in June 2022 promised to improve the Ease of Doing Business. Surprisingly during January to December 2023, the Union and State governments issued 1898 notifications further complicating the compliance canvas. Excessive regulations increase litigation and its implications.
The business professionals and the legal fraternity to keep the business landscape safe for business heads have to keep a constant eye on the ever-changing RLLC canvas. But this is not enough they also have to be abreast of the Judge's law which forms an important ingredient of RLLC.
Non-compliance with mandates can pose a serious challenge to businesses. It can lead to penalties and imprisonment, not to mention the loss of precious time, reputation & Market cap. Therefore, understanding the RLLC is important for founders, entrepreneurs, and HR professionals to ensure fair treatment of employees, and create a safe workplace. Adherence to Labor laws ensure fair wages, working conditions, benefits for employees and mitigate penalties. Compliances also foster an inclusive work environment, enhance employee morale and contribute to retention. Additionally, it protects business reputation, enhances operational efficiency, and contributes to long-term sustainability. The regulatory compliances are constantly evolving and there is a need to be updated on the changes.

Day 1 : Minefield of Indian labour Laws
Who is a workman/worker?
Management of Contract Labour:
Deployment of contract workmen instead of direct workmen is a norm established in the last decade in view of the ease of managing the workforce. However, if the management is not careful in following the regulations set out by the Contract Labour Act (CLRA) and also standards established by the catena of judgements by Hon’ble Apex Court, there can be serious challenges. Thus, usage of outsourced labour is not a panacea but can pose a dilemma to the business in view of the judgements in the last few decades. This section of the training analyses about a dozen dilemmas and provides solutions for successful implementation of outsourced manpower.
Management of Discipline:
Time and again managements get into expensive and sticky situations due to lack of experience, expertise and knowledge in dealing with matters of indiscipline. Much is written, discussed and debated on the subject. The court rulings have clarified many important aspects in the sensitive area of discipline management. In-depth knowledge and preciseness of actions is essential in the successful handling of the sensitive subject since the issue besides involving matters of discipline in the establishment simultaneously though quietly, is capable of disturbing the emotional quotient of the establishment and its employees.
This interactive session will cover the key principles of natural justice, misconduct under Standing Orders, procedures to be followed by the management while initiating any disciplinary action, and successful closure of disciplinary action – all with inputs from some landmark Supreme Court orders
Recent Provident Fund Law Implications:
In 1963, the Hon’ble Apex court made its views clear to both employers and the EPFO authority on the subject of deductions from wages in Bridge & Roof Vs Union of India. However, in 2005 the Apex court once again gave its verdict in Gujrat Cypronet Vs PF Commissioner and then again in 2019 in the matter of RPFC Vs Vivekanand Vidymandir.
PF deduction is a subject which continues to haunt the business professionals and thus is a large and important part of business decision-makers. The consequences are severe in case of any error. Precisely this will be discussed during the dedicated session.
Women Employees Right to Maternity Benefit
the great contribution of women to businesses is unquestionable. However, despite that their right to maternity benefit at times is not respected.
Considering that there are a significant number of women employees in various business sectors it is important that the key functional heads be aware of the implications of non-compliance with the provisions of the law on the subject and views of the judiciary.
Day 2 : PoSH Act and Diversity
DIVERSITY: PREVENTION OF SEXUAL HARASSMENT ACT
With the improved access to education, technology and diverse employment opportunities, millions of women are entering the country’s workforce today. The total number of women workers in India was 149.8 million (source: census, 2011). Out of this 121.8 million are from rural areas while the remaining 28.0 million are from urban areas.
The Constitution
While the articles 14&15 of the Constitution treats that sexual harassment results in violation of the fundamental rights of woman to equity, right to life and dignity and article 21 confers the right to practice any profession or to carry on any occupation, trade or business which includes a right to safe environment, free from sexual harassment.
Evolution of Special law
However, there was no specific law for prevention of sexual harassment and protection of women at workplace, until the Supreme Court in the case of Vishaka & Ors. Vs the State of Rajasthan & others (1997), reaffirmed that sexual harassment at workplace is a form of discrimination against women and provided guidelines (VISHAKA Guidelines) to address the issue, pending enactment of the suitable legislation. The Government of India enacted the special law – Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 (known as PoSH), to provide for safe, secure and enabling environment to every woman, irrespective of her age, or employment status, free from all forms of sexual harassment by fixing the responsibility on the employer and the district authorities.
The PoSH Act has the wide scope and coverage of all workplaces, organized or unorganized and has mandated redressal mechanism by establishment of Internal Complaints Committee (IC) for organized sector and Local Committee for unorganized sector.
It is, therefore, inevitable that the business professionals are fully conversant with the law, its evolution through the Apex Court/High Courts’ rulings on the essential principles of the PoSH Act. The proposed session will cover the nuances of the law, including the criminal law remedies, establishment of well-versed ICs, organisation approach including remediation by conciliation and governance mechanism, besides ensuring diversity and inclusion in place.
Therefore, not only the business professionals but also the compliance and legal professionals, must be conscious, agile and develop competence required in the changing legal landscape. This MDP is to make you aware of your obligations, liabilities and mitigate the risks in a systematic process.

DSP Pension Fund
Headquarters
Dr Nehal Joshipura, associate professor at Chetana’s Institute of Management and Research, conducted an employee training program for DSP Pension Fund at their headquarters on 4, 5, 6 April 2024 on the topic of ‘All about Mutual Funds’.
The training program was divided into four modules. The first two modules were about equity and debt markets. The third module covered from the definition to the performance evaluation of mutual funds covering all the types of funds and related terminology. The last module was on financial planning using mutual funds so the employees can rightfully advise the investors.
The training was attended by all the team leaders at national and regional level with their team members. The average experience for the participants was 20 years. The CEO, CIO (chief investment officer), and fund managers also added some inputs during the training. The training was delivered in an interactive discussion format with the related activities for each session.

Overview:
One of the key challenges faced by sales organisations is the smoothly manage the transition of individual contributors to a leadership / managerial position. On Saturday, 27th August, 2022 Chetana’s Institute of Management and Research conducted a Management Development Program on the topic, “Investing with Derivatives – A New Perspective .”
Dr. Chirag Shah was the resource person for the program. The session started with inauguration by the CEO – CIMR, Dr. Madhumita Patil, and Director - CIMR, Dr. Nandita Mishra. 11 participants had attended the program.
During the 8 hours session, Dr. Chirag Shah gave a new perspective toward the derivatives as a financial instrument. He elaborated on the use of derivatives as a risk management instrument. At the same time he emphasised on the right use of leverage for wealth creation.
The participants were happy to learn that Derivatives can be used as a long term investing tool rather than just a speculative tool with a zero sum game. They appreciated the way Dr. Chirag Shah cleared all the concepts without diving too much in the technicalities and by keeping things simple.
At the end of the session, the participants were more confident to use the financial instruments for their personal wealth management. They also gave their qualitative feedback to the CEO about the session.
The session ended with the certificate distribution by CEO ma’am to all the participants.
